Texas WC Exclusive Remedy Doctrine in Jeopardy

The American Insurance Association (AIA) is urging the Supreme Court of Texas to overturn an appellate court’s decision that failed to recognize and preserve the exclusive remedy doctrine of the state workers’ compensation system. In Reynolds Metals Company and Arlon Boatman v. Kelly J. Welch and Allison Welch, the appellate court permitted the claimant to maintain a civil action, despite the failure to present any evidence that the claimant's injury resulted from subjective intent by the employer.

"Under the exclusive remedy rule in workers' compensation, an injured worker may maintain a civil action only when there is an intentional injury, meaning a subjective intent on the part of the employer to injure the worker. Otherwise, the no-fault workers’ compensation system must be the claimant’s exclusive remedy", said Ron Cobb, AIA vice president, southwest region.

According to Cobb, if the appeals court ruling is permitted to stand, Texas courts will be overwhelmed with a flood of similar cases. "Plaintiffs who allege exposure to asbestos at the workplace but who are not sick will be permitted to file lawsuits and clog access to courts and delay adjudication of the claims of truly injured people," said Cobb. "Additionally, the weakening of the exclusive remedy rule will permit other injured workers to bypass the no-fault workers’ compensation system in favor of court actions, causing dramatic cost increases and instability in the Texas workers’ compensation system."

"The Court should grant review of this case to properly enforce the ‘intentional injury’ exception to the exclusive remedy doctrine and clarify that workplace injury claims must remain within the workers’ compensation system unless there is proof of actual subjective intent on the part of the employer to cause the claimant’s injury," Cobb concluded.

NAMIC Launches MoldUpdate.com
The National Association of Mutual Insurance Companies (NAMIC) has launched a Web site that will disseminate information about mold to the insurance industry. MoldUpdate.com will provide current news, education, scientific links, litigation updates, state legislation and act as a clearinghouse for insurance industry issues relating to mold. The site will be non-partisan and not-for-profit. 

MoldUpdate.com's mission is to offer clear and factual information to interested parties on the matter, in an attempt to offer scientific and rational discourse.  NAMIC plans to develop and assemble content that would assist the insurance industry, general public and news media on the subject of mold.

"From the standpoint of commercial exposures, toxic mold claims are beginning to rival 'construction defect' claims in their numbers and magnitude," according to Bill Wilson of the Independent Insurance Agents of America.  Some analysts are making the analogy that toxic mold claims could be the next asbestos.


Layoffs at USAA & AIG

According to an online article in National Underwriter magazine, mutual insurer United Services Automobile Association (USAA) announced that it plans to cut about five and a half percent of its total workforce, an equivalent of 1,370 jobs out of 24,000.  The article said that approximately 85 percent of the jobs to be eliminated are at company headquarters in San Antonio, Texas.

American International Group, Inc. (AIG) recently announced that net job reductions spread over the next 12 to 18 months resulting from the acquisition of American General Corporation (AGC) will total approximately 1,500 in several AIG and AGC locations in the United States.  These reductions result primarily from operating efficiencies to be derived through the combination of various AIG and AGC units, as well as attrition. 

AIG's total worldwide employment, including American General employees, currently approximates 85,000.


 
Free Collision Estimating Procedure Pages
 
SAN DIEGO--(BUSINESS WIRE)--Sept. 10, 2001--As a service to the collision repair and insurance industries, Mitchell International, Inc. announced today that it is supplying free online access to Procedure pages (P-pages) for its print and electronic estimating products. The information can be accessed at www.eMitchell.com, Mitchell's open Internet workspace and marketplace for the collision repair and claims industries.

Mitchell's P-pages list collision repairs by type, such as "Front Suspension O/H," and then list the labor operations included or not included in the replacement allowances in Mitchell's estimating systems. Mitchell's Collision Estimating Guides' P-pages cover labor operations for replacement with new parts, while its Replacement Assemblies Estimating Guide covers those with recycled parts and assemblies.
 
To access the P-pages, users need to have or to create an account at www.eMitchell.com. Creating an account is free and requires users only to fill out a short, simple form that is accessed by clicking on "create an account" on eMitchell.com's home page. Once completed, users click on the Industry tab in the upper left-hand corner and then click on the eMitchell products tab at the top of the page. Next click on the "Ppages" link displayed on that page, which will open the Procedure Pages.
